This section outlines the specific rights and responsibilities of users who operate as Sellers on Marketsy.ai. Being a Seller involves not only the privilege of utilizing Marketsy.ai to reach a global audience but also the responsibility of adhering to our platform's standards and regulations.

2.1 Seller Rights

• Create Multiple Stores: Sellers have the right to create and operate multiple stores on Marketsy.ai, allowing for the diversification of products and services offered to customers.

• Promote Stores and Products: Sellers are encouraged to promote their stores and products. Marketsy.ai supports and facilitates such promotions, provided they comply with our terms and ethical marketing practices.

• Intellectual Property Rights & Ownership: Sellers has full ownership on content they create on the platform, including generated via AI.

2.2 Seller Responsibilities

• Compliance with Product Listings Policy: Sellers must ensure that all items listed for sale comply with Marketsy.ai's permissible items policy (refer to Section 5). This includes avoiding the sale of prohibited items and adhering to our guidelines regarding acceptable products.

• Provision of Customer Support: Sellers are responsible for providing comprehensive customer support for their products and stores (refer to Section 6). This includes handling customer inquiries, resolving disputes, and ensuring a satisfactory shopping experience.

• Adherence to Marketsy.ai's Terms and Policies: Sellers must conduct their activities in compliance with all relevant sections of Marketsy.ai's Terms & Conditions. This includes provisions pertinent to maintaining a safe and lawful eCommerce store.

• Foreign Content Reuse: Any content (audio, video, text, images or other materials visible on seller store) must be your own and must not be invading any third-party's rights. Marketsy.ai reserves the right to remove any of Your Content from this Website at any time without notice if there would be an evidence of damage and re-usage of a foreign Intellectual property.

2.3 Obligations Under Seller Responsibilities

1. Ensuring Product Safety and Legality: Sellers are obligated to ensure that all products sold through Marketsy.ai are safe, legal, and comply with our platform's standards. This includes conducting due diligence on the products offered and adhering to all applicable laws and regulations.

1. Engagement in Ethical Marketing: While promoting their stores and products, Sellers must engage in truthful, non-deceptive advertising practices that accurately represent their products and services.

1. Proactive Customer Support: Sellers are required to actively manage their customer service obligations, including promptly responding to customer inquiries, processing returns in accordance with their stated policy, and addressing any customer concerns related to their products.

3. No Warranty on Third-Party Products

Marketsy.ai does not manufacture or inspect any of the products sold through its platform. The products are produced, listed, and delivered directly by independent sellers. We make no warranties regarding the quality, safety, or legality of any products sold. Any legal claim related to a product you purchase must be brought directly against the seller of the product. You release Marketsy.ai from any claims related to items sold through our platform, including for defective items, misrepresentations by sellers, or items that caused physical injury (including product liability claims).

4. Payment and Refunds

Marketsy.ai operates on a no-refund policy for all payments made directly to the platform. Please ensure you are sure before making any payments to Marketsy.ai, as all sales are final. However, this policy does not apply to payments made to sellers on their individual stores, which may have their own refund policies.
